Conditions of Use

We understand that your order is meant for a very special person/occasion. We at Max's Group Inc. only aim to deliver your order to your friends and loved ones within the Philippines based on the specific date and time that you have chosen. To ensure proper and timely delivery, please read and follow our Conditions of Use below:

Online orders must be placed:

• at least 1 hour in advance (for Deliver Now transactions and Pickup)
• at least 2 hours in advance (for Deliver Later transactions)
• at least 24 hours in advance (for Dine-in transactions)

All transactions will be settled in PHP (Philippine Peso currency), and the minimum required purchase is worth PHP 350.

Credit cards/ATM cards/other online payment facilities will be billed at the same time the order is placed.

As proof of a fulfilled order, an electronic copy of the order confirmation letter will be emailed to the purchaser indicating the time, date, name of the recipient and other details of the order.

Revisions and cancellations should be made:

• at most 5 minutes after order is placed (for Deliver Now transactions)
• at most 1 hour after order is placed (for Takeout and Deliver Later and Dine-in transactions)

The sender is required to contact Krispy Kreme Online team via email or telephone for cancellation or revision of online orders.

Max's Group Inc. Online reserves the right to reject order cancellations requested beyond required cancellation/revision lead times.

Revisions/changes in the order are subject to confirmation and additional cost when applicable. Said changes/revisions may cause delay in delivery.

The delivery area for provincial branches is within a 5 kilometers radius of the branch.

Some provincial areas are considered unserviceable. Krispy Kreme Online will update you if your recipient's address cannot be serviced by our delivery team.

Collection of Personal Data

The Company collects Personal Data you voluntarily submitted in our Site, as well as non-personal information provided therein.

We will not sell, share, or rent your Personal Data to others in ways different from what is disclosed in this statement.

User registration and purchasing a product: We collect information about you (i) when you use any web-based service offered through our Site; (ii) when you register in order to receive a product/service; (iii) when you subscribe to marketing emails; and (iv) when you contact us for inquiries, support or feedback. Log information: When you visit our Site, we may also collect non-personal information such as but not limited to web page from which you came to our Site, your web page request, Internet Protocol (IP) address, geolocation, browser type, browser language, the date and time of your request and your registration data. Please be noted that when you purchase a product or use a web-based service in our Site, we may also log the specific path, actions, and navigation choices you make.

Third-Party Payment Processor

The Company takes the security and privacy of your billing information seriously. All credit/debit card payments are processed over a secure connection using PesoPay’s PCI-compliant gateway. We do not store credit/debit card details and instead relies on PesoPay for this. To save a new credit/debit card to your account, go to the payment options, select “pay online via credit card”, check the box "Save credit card information", then click continue. If you saved a credit/debit card to your account, you will not be able to update the existing card information, but you can delete it from your account on the same page. You can save a new credit/debit card to your account the next time you order from our Site. Your CVV/CVC is always required to be manually encoded for every transaction, for validation purposes.

Tip: If you don't want to save your credit/debit card information to your account, make sure to un-check the box next to "Save credit card information."

Further Disclosure

We take reasonable precautions to be sure that nonaffiliated third parties and affiliates, to whom we disclose your Personal Data are aware of our Privacy Policy and will treat the information in a similarly responsible manner. Our contracts and written agreements with nonaffiliated third parties that receive information from us about you prohibit those parties from transferring the information other than to provide the service that you obtain from us.

Retention and Disposal

Please read these terms of use for Yellow Cab Pizza Co.® You Do You Rewards (Philippines), hereinafter the “You Do You Rewards,” carefully before accessing or using the same. If you do not agree to this Terms of Use, please do not proceed or participate in You Do You Rewards. By accessing our You Do You Rewards, you agree to be bound by the Terms of Use described herein and all terms incorporated by reference.

These Terms of Use apply to your access to and participation in the You Do You Rewards program of Yellow Cab Pizza Co.® (“Yellow Cab”) in the Philippines. These Terms of Use do not alter in any way the terms or conditions of any other agreement you may have with Yellow Cab for products, services, or otherwise. Yellow Cab reserves the right to change, modify, and/or terminate the You Do You Rewards and/or these Terms of Use or any policy or guideline pertaining to You Do You Rewards at any time and in its sole discretion. Any change or modification will be effective immediately upon posting on the About You Do You Rewards section found in delivery.yellowcabpizza.com, and you waive any right you may have to receive specific notice of such changes or modifications.

Your participation in You Do You Rewards signifies your acceptance of these Terms of Use and any changes or modifications. Joining You Do You Rewards

In order to sign up for Yellow Cab’s You Do You Rewards program, you must have a verified delivery account on delivery.yellowcabpizza.com

1. If you do not have an existing verified delivery account, you will need to first create a delivery account and verify it. The enrollment to the You Do You Rewards will be in the form of a tick box in the delivery account registration form. Please note that the creation of a delivery account on delivery.yellowcabpizza.com may require you to provide certain personal information including but not limited to name, physical address, email address, contact number, birthday, and marketing preferences. All personal information which you will provide to us in the course of registration will be held and processed in accordance with the Yellow Cab Privacy Policy.
2. If you have an existing verified delivery account and have chosen to receive promotional and marketing offers from Yellow Cab, you will receive an email prompting you to sign up for the You Do You Rewards program. Alternatively, if you have chosen not to receive such messages, you will see a pop-up message inviting you to join the program when you log in to your delivery account. Both options will bring you to a page within the delivery site asking you to tick the boxes to sign up for the You Do You Rewards program.
3. Upon submission, you will receive an email advising you that you have successfully registered for the program.

Earning Points

You may earn points on your online delivery orders made through delivery.yellowcabpizza.com only. You will earn points if you have at least one (1) a la carte pizza of any flavor, size, and crust included in your transaction. Each valid transaction with at least one (1) qualifying product will allow you to earn one (1) point. Multiple a la carte pizza orders in one transaction is equivalent to one (1) point.

You will not earn points on the following transactions regardless if the qualifying product is added to cart:

1. E-Party and Pick-Up transactions
2. Promos and bundles
3. Orders given discounts including but not limited to Senior Citizen and Persons with Disability discounts.
4. Bulk orders or orders amounting to over P7,000

You may have multiple transactions in a single day, and each transaction will allow you to earn one (1) point each provided that each transaction includes at least one (1) qualifying product.

Your points will be credited upon completing the transaction, regardless if the order has been fulfilled already or not. However, transactions that will need to be cancelled will also have the corresponding point rendered void.

Your points earned will be valid until December 31 of the same year. However, all your points earned during the month of December will automatically be carried over to the next calendar year, i.e. All points earned until November 30, 2021 will expire on December 31, 2021; All points earned within the month of December 2021 will expire on December 31, 2022.

Redeeming Points

You may redeem a free 12” pizza of any flavor and crust once you have reached three (3) points. Participating products include:

1. Classic NY-Style Original or Thin Crust Pizzas: Hawaiian, Pepperoni
2. Signature NY-Style Original or Thin Crust Pizzas: BBQ Chicken, Garden Special, Manhattan Meatlovers, Roasted Garlic & Shrimp, Patty Melt, #4 Cheese.
3. Dear Darla® Specialty Hand-Rolled Pizzas: Original Darla, Roasted Garlic & Ricotta

A progress tracker found on the Homepage and the You Do You Rewards section of your My Account page will show you if you are already eligible to redeem points. A “Redeem Free Pizza” button by the tracker may or may not be clickable depending on the points you have earned.

To redeem, you must click the “Redeem Free Pizza” button to receive the email containing the unique promo code for the free pizza. Point deduction will be made once you click the “Redeem Free Pizza” button regardless if the free item has been claimed or not.

The free pizza redemption email will contain your registered name in You Do You Rewards account together with the unique promo code. The flavor and crust of the free pizza may be selected upon redemption.

The free pizza may be redeemed from any participating store either via online delivery, hotline delivery, take-out, or dine-in. Please note that the claiming of free products through pop-up events, booth selling, and food trucks is not allowed.

To facilitate the redemption of the free pizza, you must present the following:

1. Online Delivery. You must log in to your account on delivery.yellowcabpizza.com and input the unique promo code in the proper field to redeem your free pizza. Please note that the promo code will only be accepted if the email address used to redeem the free pizza is also the same email address using the promo code. In addition, if you redeem the free pizza without ordering any other item, a fixed P50 delivery fee will be applied. 3. Dine-In/Take-Out. You must present to the store crew either a screenshot or print-out of the free pizza redemption email indicating your name and the unique promo code together with a valid ID. You may ask a representative to claim on your behalf provided that your representative is able to present the same free pizza redemption email containing your name and the unique promo code together with a copy of your valid ID.

Your points converted into free pizza promo codes may be redeemed within the same calendar year only. Your unclaimed promo codes will be nullified after December 31 of every year.

Birthday Gift

If you have accumulated at least two (2) points from your birth month in the previous year to the month before your birth month in the current year, regardless of conversion or availability status, you may claim an annual gift of one (1) free regular pasta, either Chicken Alfredo or Charlie Chan®.

If you are eligible to receive the Birthday Gift, you will receive an email on the first day of your birth month advising you that your Birthday Gift coupon is available already for claiming on delivery.yellowcabpizza.com. You must click the “Claim Birthday Gift” button to receive an email indicating your name and the unique promo code for the free pasta. No points will be deducted from your account when you claim your Birthday Gift.

You may redeem your free pasta from any participating store either via online delivery, hotline delivery, take-out, or dine-in. Claiming of free products through pop-up events, booth selling, and food trucks are not allowed.

You may receive emails from time to time advising you that you are qualified to redeem special offers as a member of the Yellow Cab You Do You Rewards program. In order to receive these special offers, you must opt-in to receive promotional and marketing offers from Yellow Cab. These special offers may be customized or personalized according to your purchasing behavior and preferences, which may include members-only prices and early access to new products, among others, and may have certain restrictions such as limited time or mode of redemption. These special offers are personalized to you and may not be shared, copied, or transferred to other customers, regardless of membership to the You Do You Rewards program.

Other Important Information

Registration to the Yellow Cab You Do You Rewards program is free. The program is exclusive to orders made in the Philippines only. Furthermore, orders must be for delivery and made online through delivery.yellowcabpizza.com. Points may be earned on orders paid with cash, debit card, credit card, GrabPay, and GCash only. Points have no monetary value and therefore may not be exchanged for cash. Points earned through the program and the corresponding benefits are exclusive to you and are non-transferrable.

Without notice to you, Yellow Cab reserves the right to suspend and/or terminate your You Do You Rewards account including your points and other benefits if Yellow Cab, at its sole discretion, determines that you have violated or have breached any of these Terms of Use, or that the use of your You Do You Rewards is unauthorized, deceptive, fraudulent, or otherwise unlawful. Yellow Cab, at its sole discretion, may suspend, cancel, or combine You Do You Rewards accounts that appear to be in violation of these Terms of Use. In the event that your membership to the You Do You Rewards program is terminated, all the earned points and other benefits associated with your account shall be rendered void.

In the event that the You Do You Rewards program is terminated, these Terms of Use shall continue to apply in respect of any engagement while the program was in force. Any dispute arising from these Terms of Use will be governed by and enforced in accordance with the laws of the Republic of the Philippines, without regard to conflict of law rules or principles. Any suit or action in connection with the You Do You Rewards shall be filed with the proper courts of Makati City, to the exclusion of all other courts.

If any provision or part of a provision of these Terms of Use is declared unlawful, void, or unenforceable, that provision or part of the provision shall be deemed severable from these Terms of Use and does not affect the validity and enforceability of any remaining provisions therein.
